My EAD application has been pending more than 90 days.
Just called the USCIS office.
Look like the center it has been sent to is processing EAD's of date: May 03.
So my application is still 2.5 months away.
The agent tells me that I can get an interim EAD, by scheduling an appointment using InfoPass: http://infopass.uscis.gov/index.php
Just posting this since, I had earlier asked about the 90 day rule for EAD's(if you do not get within 90 days, you can get from local office) and everyone told me that .. this rule was dead and buried.

Then you should either get an interim EAD or the real thing from the processing center within two weeks.

USCIS decided a date Jun 1, 2006 to be current for EB2, so that Visa Numbers are not lost this year. This they decided on the basis of numbers of applications they were able to process by Jul 8, 2008. We all know that I485 Processing Date for NSC was Jul 28, 2007 and TSC was July 17, 2007. These dates were posted on Jun 15 and by July 8, might have moved by a day or two.
Last year USCIS announced (I remember it was last quarter) that for processing all the files received will take around 18 months. We have just 6-9 months gone.
Jul - Sep, the Priority date should not change, because USCIS has to approve all the processed application, they think approvable.

On the whole issue of EB retrogression, This current batch of EB based green cards have waited the longest number of years in the history of green cards.
So, sooner or later, someone in the goverment will have to answer why is that they let so many people apply green cards when they did not have a numbers solution ready.
Why were we even allowed to file for Green Cards when they could only issue a certain number based on the Country of Birth, each year.
This is like sell a product to someone, send him an invoice, and he comes back and says, sorry, we have a country wise quota, so even if we bought these goods from you, we wont pay you cos the quota for this year is up.
No, literally, export quotas work that way, they put a quota on sourcing, not on payments.
Why not do the same on Green Cards?
So, this whole mess, what is the right amount of time (in years), that it starts turning into a 'rights' issue from a 'flawed process' issue.
Currently, unless we have some representative in the government, who sees this flaw as a real issue, it is only us non-immigrants who can push this harder, and generate that representative, who instead of sliding this issue along with some big Financial bill, lobbies hard to get this issue resolved, as a separate entity..

In conservative view, though both are in same field, both are not similar occupation becuse one is "engineer" and other is "manager". Engineer skills and responsibilites and duties are different than manager. So it will not qualify to AC21 portability. For similar occupation classification, both should be in same family in Onet or it should have first 2 numbers in the code should be same.
thats not true..AC 21 does'nt deny a promotion..Since it takes over 5-7 years to get GC approval, most of my friends got their GC when they were project managers/product managers but started as applications/network engineers.

hello all,
i attended for visa stamping on dec 1st at Hyderabad consulate so i got 221g yellow form but he retained passport with him. he told to submit all the documents that are mentioned on the yellow form. did any body got same thing. usually how many days they will take for processing after submiting the documents

I did some mistakes when I went for Visa intervew in March 2007, I have done a new form on line and printed again.If they have not changed the usage of online DS-156 you could do the same thing.
Some fields cannot be edited after you save for the first time like Passport Details (Number, Place of issuance etc).

1. What all documents are required apart from AP to re-enter US?
2. Do you get I-94 if you enter with AP and if yes How long that I-94 is valid for? I am bit confused as my AP is going to expire in Jan 2008, so the USCIS should not give me i-94 till Jan only? If yes, then what after that?

This means that if the primary beneficiary is using visa number from EB(2) classification then dependent(s) will also be using the same classification as primary beneficiary (i.e. EB(2) in this example).

Oh, I forgot in the above instructions. Manually focus so that nothing is in focus. That pretty much assures the only thing in focus is the dust/dirt.

Just a clarification, did you continue to maintain H1 status or started using EAD after you entered using AP.
Yes, I did the same.....even though I had a valid H1B stamped in my passport the POE made me use the AP to enter.....
