A friend of mine (Indian) is married to an Indonesian. Both are on H1B and have approved I-140s. Can my friend apply for a cross changeability? Does it have to happen when my friends spouse's pd becomes current? or can it be done earlier?
Yes he can use Cross changeability.

My I-485 is pending with EB3 Feb 2006 priority date. Invoked AC21 and currently working for a different employer. Have Masters degree and 9+ years of experience.
Is there a way to re-apply for Green Card under EB2 category thru a 3rd employer and retain the old EB3 priority date?

(1) I have applied for my OPT very recently with a start date of oct1, 2007 and its in the processing stage.
(2) I am planning to apply(say by August 1st, 2007) for 140/485 concurrently in EB2-NIW category, as the PDs have become current.
Will my OPT be rejected because of the pending 485? Is it possible to file 140/485 concurrent or should I wait till my OPT is approved (by that time the PDs will no longer be current...hmmm). Your valuable suggestions are needed. Pls help me....

Guys,
I am generally a lurker in this website. Based on the other threads, I came to the reality there is no way I am getting my GC for another 4-5 years or may be even longer.
However, the USCIS site has a status "Card/Document production". The last status update date was 6/25/2010. The only update I could think of is my new address around the same time. I went to the USCIS status website after 2 years out of curious, after I got back from giving my finger prints (3rd since I485 filing) today.
Is the USCIS jerking me off? :rolleyes:

I received a RFE of my I485, and was asked to declare my self-employment since Dec,31, 2006. I have been engaged in Market America Direct Sell business part-time since August 26, 2005, and have claimed buinsess lost in my tax return since 2005. In 2006, I got a 1099 form that showed $600 income from Market America. After that I didn't have any income from the business.
My question is if I am self-employment. If so, do you have any way to resolve this issue?
My last entry into USA is 07/05/2008, but the I-94 was not replaced at Niagara Falls port. The last entry date on my passport is still Dec, 31, 2006.
My EAD start date is 7/31/2008.
I am looking for an Attorney who is an expert at this case to reply my RFE and resolve my pronblem.

California taxpayers need to cover higher fees of private lawyers, who are hired by the state as the Attorney General's Office doesn't have the staff to handle all of the cases internally. Yes, you don't have to be in the US while the 485 is pending. You will need to be here for any appointments - fingerprinting, interview, etc. You also need to intend to be a permanent resident and work in the position listed on the I-140 (assuming this is an employment-based case). CIS might issue an RFE on the 485, asking for evidence of this, so you need to be able to provide it.
