Hi, My wife has started working on EAD as an individual contract employee and her employer is asking to complete W9 form. But in the form it says that only US citizen can complete that form. Also it asks for backup withholding. I am not sure what it is.

I am confused now. I know that EAD has no restriction in employment. Pl. help.

My company changed address while my transfer H1b petition was pending. We moved just across the street from the original location and thus the company did not call USCIS to notify them of the address change because we still had access to our old mail box. Unfortuanately my approval notice was returned back as undeliverable and I received an email to that regard.

The secretary from office called USCIS and had the address changed immediately, its already been a month but we still haven't received the approval notice at the new address...has any one else here has similar experience...how long do you think we should wait before we call the USCIS again ?

If your company is having layoff they cannot start new GC labour. But it has nothing to do with 485. And as in your case it doesn't stop the processing.;)

I have requested USCIS to inquire on my status. They did. I got a mail stating that background check is still open.

(800)375�5283
1 -2 -6 -1-enter LIN# - 3 -3 -1

Background Check:

1. The Interagency Border Inspection System (IBIS) Name Check
2. FBI Fingerprint Check - Completed - USCIS message
3. FBI Name Checks

I went for my 3rd FP 2 months back.

My question is, Whenever the Finger Print expired in 15 months,

Will ALL 3 of the above background checks be validated again OR ONLY FP validated every 15 months?


EB2 - INDIA
Priority Date: October 2003
I-485 Notice date: April 2004
3rd FP completed on: May 2007

Hi,

A couple of events are happening in my life now:

* My current L1-B expires in June
* I am getting married in April - So I am traveling to India in April, returning in May.
* My company is planning to apply for my L1-B extension.
* My future wife will try to get her L2 in April, after our marriage, planning to come with me in May.

I hear that i am not supposed to be traveling while the L1-B is being extended. I also hear that the consulate may reject L2 if the L1 is about to expire.

1. Are these above rumors true ?

2. Is there a problem if my company applies for my L1-B extension and I travel to India at the same time ?

Hi,

Can we apply for a new EAD/AP after they expire?

If so, what is the difference b/w applying for an extension vs. a new one in terms of fees/documents/photos/etc.?

The reason being I already spent $1000 for EAD/AP last yr. but never used it, and now I have bear all H1 (extension) expenses as well as employer sucked all my blood & is after my limbs after 8 years of slavery. On top of that has stopped paying salary since April.

Hence I am trying to cut corners whenever wherever possible. Any responses or help greatly appreciated.

i am waiting for my priority date to become current to file for I-485. But it looks it'll take forever, as evident from May 09 visa bulletin, in which the visa dates are unavailable for EB3 India category. Do you know why dates are retrogressing or stagnant in bulletins after bulletins.
I have another question. My birth certificate is in an Indian language which was issued from the panchayat office where I was born. I want to know if that can be translated to English right here in US for I-485 application. Can somebody else who is not related to me write the translation in English and then get it notarized? If this is the case, then I don't have to go to India or get it done from there from the panchayat office, because this may take a long time. If anyone had tackled issues such as this, please share.

One think people don't get is, whether the current/future job qualify for EB2, It doesn't matter even you have a Phd and the job only requires Bachelor or equivalent then it is EB3, also certain programming jobs doesn't qualify for EB2. First ask your HR for min job requirement!:(

I have bachelors degree in law and 7 years human resource training development manager. Could I apply for eb2?

I have a approved I140 from my current employer with prority date of may 2006. I had applied a labor long time back in Jan 2004 with another employer. This labor is approved now. Can I apply another I140 with the old empoyer without revoking the one that I have with the current employer as I want to stay with the current employer till I get the new I140 approved? Will applying the I140 with the old affect my current I140 approval.
Please help, I have to decide soon.
